Emanay AI Terms

These terms apply to every AI Feature in the Emanay Products, in addition to Part 1.

1. Your commitments

1.1 Eligibility. You may use AI Features only if you are 18 or older and an authorised user of the Emanay Product in which they appear.

1.2 Acceptable uses. Use AI Features only for the purpose your account was issued for and in line with Part 1 and Part 4.

1.3 Prohibited uses. You will not use AI Features to:

  1. do anything illegal, or help anyone else do so;
  2. create deceptive or misleading content, including false statements about visas, investments, deals or legal matters;
  3. impersonate any person, client or member of the Emanay Group;
  4. scrape, extract or collect data, or generate data to train other AI models;
  5. infer emotions of people in a workplace or educational setting;
  6. categorise people by biometric data, or infer sensitive characteristics such as race, religion, political views, health or sexual orientation;
  7. try to override, bypass or disable safety controls, filters or usage limits;
  8. rely on AI output in place of a qualified professional for legal, tax, accounting, investment or immigration decisions.

2. Prompts, results and other content

2.1 Your rights. You keep the rights you have in the prompts and files you give AI Features (“Inputs”). Results generated for you (“Outputs”) are treated as Your Content or Work Product under Part 1, section 3.

2.2 Media processing. If you upload images, audio or video that show other people, you confirm you have their consent, and any consent the law requires, for that processing.

2.3 Personal information. Do not put personal information into AI Features unless it is needed for the task and your role allows it. We process Inputs and Outputs under the Privacy Policy.

2.4 Accuracy. AI Outputs can be incomplete, outdated or wrong, and can sound confident when they are wrong. Check them before relying on them. Client deliverables are reviewed by a qualified person before they are delivered as advice.

3. Emanay’s rights

3.1 Content. We may store, process and review Inputs and Outputs to provide, secure and improve AI Features, enforce these terms and meet legal obligations, in line with the Privacy Policy. We will not use Client Data to train AI models shared with other clients or third parties.

3.2 Suspension. We may limit, suspend or end access to AI Features if we believe they are being misused or to protect clients, users or the Emanay Products.

4. Ownership of AI Features

AI Features, including their prompts, instructions, workflows, configurations and output formats, are Emanay IP. You may not copy, extract or reverse engineer them.

5. Third-party materials and models

AI Features may use models and materials provided by third parties. Those providers process data for us under contract and are not permitted to use Client Data or Inputs to train their own models. Third-party materials may carry their own terms.

6. Warranty disclaimer and liability

AI FEATURES AND OUTPUTS ARE PROVIDED “AS IS”. TO THE FULLEST EXTENT PERMITTED BY LAW, THE EMANAY GROUP MAKES NO WARRANTY THAT OUTPUTS ARE ACCURATE, COMPLETE, CURRENT OR FIT FOR ANY PURPOSE, AND ITS LIABILITY IS LIMITED AS SET OUT IN PART 1, SECTION 4.3.

7. Disputes

Disputes about AI Features are resolved as set out in Part 1, section 4.4.

8. Severability

If any part of these AI terms is unenforceable, the rest remains in force.

9. Changes

We may update these AI terms as set out in Part 1, section 4.1. AI Features change frequently; we may add, change or remove them at any time.

10. Effective date

These AI terms take effect on the date they are published.
